Northstar Electric Terms & Conditions Contract

Northstar Electrics Terms & Conditions are as follows and explains:

  • The rules for using our services

  • What you can expect from Northstar Electric

  • Your rights and responsibilities 

When These Terms Apply:

Please ensure you read these terms before requesting or using our services. By using our services, you are agreeing to these terms. 

The latest version always applies. We make updates when we offer a new service, change how we provide a service, or have to comply with a new legal requirement.

Definitions 

“Us / We / Our / Northstar / Northstar Electric”  - Refers to Northstar Electric, LLC. 

“You / The Customer” - Refers to you; the Customer 

“Technician” - Refers to the Representative appointed by Northstar Electric to carry out work

“Change Order” - Refers to a change in scope of work that was not originally included in the quote. This may be at the request of the customer, due to code compliance, in order to complete an inspection, or be necessary for the technicians to complete the service. 

 Service Calls/Jobs

Service calls are small-scale jobs that can be done sooner than quoted projects, in most cases. 

  • First hour is charged at a flat rate of $150

    • This charge covers a spectrum of operational expenses that are critical for the smooth functioning of Northstar Electric. This includes but is not limited to:

      • Infrastructure & Vehicle Maintenance

      • Staff Development

      • Quality Assurance Measures

      • Security and Compliance

  • Every hour thereafter is billed at the respective hourly rate

  • Materials used to complete a service are the financial responsibility of the customer 

Time & Material Work

The total charge to you will consist of the cost(s) of: 

  • First hour of labor is charged at a flat rate of $150

    • This charge covers a spectrum of operational expenses that are critical for the smooth functioning of Northstar Electric. This includes but is not limited to:

      • Infrastructure & Vehicle Maintenance

      • Staff Development

      • Quality Assurance Measures

      • Security and Compliance

  • Labor (the total amount of time spent by the tradesperson carrying out work) includes all reasonable time spent obtaining materials, charged in accordance with our current hourly rate.

  • Materials supplied by us, unless advised or provided otherwise

  • Any permits, inspections, disposal fees if applicable

Estimated Work

Estimates are an educated guess for how much a job will cost to complete and are not legally binding. Only when clients approve the estimate, does the estimate become a contract. Estimates will only be provided in writing, and may only be approved by the client contact.

When a written quote has been provided to you, the total charge outlined in the estimate should not exceed the actual time taken by more than 20%, but may be revised in the following circumstances:

  • If, after submission of the estimate, you instruct or advise us (in writing or verbally) to carry out additional work not referred to in the estimate. Clients will be asked to sign an “Additional Work Order Form” that will allow us to document and proceed with the changes requested. A “Change Order” will be issued on the final invoice in this case.

  • If, after submission of the estimate, there is an increase in the price of materials.

  • If, after submission of the estimate, it is discovered that there was a manifest error when the estimate was prepared. 

  • If, after submission of the estimate, it is determined that further work needs to be carried out which was not anticipated when originally assessing the project. Clients will be advised in this case, and a “Change Order” will be issued on the final invoice in this case. 

We will not be under any obligation to provide an estimate to you and will only be bound by estimates given in writing to you and signed by an authorized representative. We will not be bound by any estimates given orally or in which manifest errors occur.

In the case that a change order is necessary or requested by the customer for additional work requested after the estimate has been approved, the customer agrees to pay the additional amount due in addition to the original quoted amount due. 

Timekeeping  

Where the date and/or time for work to be carried out is agreed, we will use reasonable endeavors to ensure that the tradesperson attends accordingly. We accept no liability in respect of the non-attendance or late-attendance on site of the tradesperson, or for the late or non-delivery of materials.

We will not be liable for any delay, or for the consequences of any delay, in performing any of our obligations if such delay is due to any cause beyond our reasonable control. We will be entitled to a reasonable extension of the time for performing such obligations

Permits & Inspections

When permits are required to carry out projects and services, clients will be advised prior to pulling necessary permits. Inspections to close out permits are scheduled once payment is received for completed work. A fee is included on jobs that require permits and inspections. 

Designs, Drawings and Specifications

Clients are solely responsible for the accuracy of any electrical designs, specifications, and related data provided by them, their employees, contractors, or agents for use in our services. Even if we examine, inspect, or comment on them, Northstar Electric will not be held liable for any inaccuracies in prints or drawings resulting from the execution of services based on your instructions or provided designs, drawings, specifications, or other data.

Individuals and homeowners serving as general contractors for their electrical projects, overseeing and coordinating all construction aspects, should be aware that any additional site visits beyond the initial assessment will be subject to billing at our hourly rate.

Warranty

We provide a 12 month warranty & guarantee on labor & materials used or carried out by a Northstar technician, in respect of faulty workmanship, or electrical devices/materials only. This is active from the date of completion of work, in addition to any manufacturer’s warranty/warranties.

The guarantee will become null & void if the work/appliance completed/supplied by us is:

  • Subject to misuse or negligence.

  • Repaired, modified or tampered with by anyone other than a Northstar technician. We will accept no liability for, or guarantee suitability for, materials supplied by you & will accept no liability for any consequential damage or fault.

Work is only guaranteed in respect of work directly undertaken by us and with full payment having been made. Any non-related faults arising from work which has not been undertaken by us will not be guaranteed.

Invoices & Payments

Upon your agreement for us to carry out quoted work, a deposit will be required to schedule the service. We reserve the right to request full payment in advance at our discretion. You accept sole liability to make payment in full, unless you disclose when initially instructing us to carry out work and/or supply materials that you are acting on behalf of a third party.

Unless alternate agreements have been made between the client and Northstar, we will issue an invoice for the final amount due upon completion of the projects and services. Invoices will be due upon receipt, and can be paid via check, bank transfer, Paypal/Venmo, or credit/debit card. To process card payments, a 4% processing fee will be added to do so. 

All invoices unpaid after 30 days will be subject to a 3% late fee penalty. Late fees will compound monthly until the invoice is paid in full.

Checks may be made payable to Northstar Electric, LLC. and mailed to 26 North Underhill Station Rd. Underhill, VT 05489. Bad checks will be subject to a $30 penalty fee. 

Unpaid & Overdue Invoices 

In the event that a client fails to remit payment for invoices within the stipulated period and extends beyond the provided grace period, or should the client choose not to remit payment without valid cause, Northstar asserts the right to cease our involvement and progression with ongoing projects associated with the unpaid invoices. This measure is implemented to safeguard the financial integrity and operational efficiency of the company.

Failure to address overdue invoices within a reasonable timeframe may lead to the termination of the client's contract(s) with Northstar Electric. Clients facing challenges in meeting payment obligations are encouraged to communicate promptly with Northstar Electric to discuss potential resolutions. The decision to terminate contracts rests at the sole discretion of Northstar Electric and is executed to preserve the financial equilibrium of the company. The client shall be formally notified, in writing, of the contract termination, outlining the specific grounds and consequences of such an action.

Legal Recourse

Should any issues persist with client(s) failing to rectify outstanding payment matters, Northstar Electric reserves the right to pursue legal avenues to recover unpaid amounts. All costs associated with legal proceedings will be the sole responsibility of the client.

Termination of this Contract  

Contracts may be terminated if client(s) fail to comply with obligations under this contract. We may also bring this contract to an end immediately if client(s) are the subject of a petition for a bankruptcy order, or you become insolvent or enter into any composition, scheme or arrangement with your creditors. If you are a corporation or other legal person, we may bring this contract to an end immediately if a receiver (including an administrative receiver) is appointed over any of your assets or an application is made to appoint an administrator for you. If you are in partnership, we may bring this contract to an end immediately if the partnership is dissolved. 

If this agreement ends for any reason, we will be entitled to remove all of our equipment and or materials from your premises or from site. You will remain liable to us for any sums which you have not paid, or permits pulled for all work done up to date of termination and for any other breaches of this contract.

Cancellation   

If you need to cancel or rearrange your booked service date, you must notify us via email or phone by 3pm on the day before the scheduled service date. 

If you cancel your project or service after that timeframe, or not at all, you will be liable for the cost of any time and or materials ordered for the job. A cancellation fee of $150 will be billed to the customer in addition to any time or materials ordered.

Force Majeure

We will not be liable to you for any failure to perform our obligations under this agreement where that failure results from any cause outside our reasonable control, including but not limited to natural occurrences, disruption of power supplies, the action of third parties or industrial action.

Liability

We will only be liable for rectifying our own warranted work, and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested and not undertaken at the time.

We will not be held liable or responsible for any damage or defect resulting from work not covered under warranty, or where recommended work has not been carried out. Work will not carry a warranty where you have been notified by the tradesperson either verbally or in writing.

We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such a delay is due to any cause beyond our reasonable control and we shall be entitled to reasonable time extensions.

We will be entitled to fully recover the costs or damages from any non-Northstar Electric tradesperson whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of work.

General 

These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorized representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.
